Section 01

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "User") and Precision Forge Labs ("we," "us," "Company"), the operator of akaraonline.co.in and the brand Atelier Ākāra.

Your use of this website, creation of an account, or placement of an order constitutes your unconditional acceptance of these Terms in their entirety, including our Privacy Policy, Refund Policy, and Shipping Policy, all of which are incorporated herein by reference.

Eligibility

To use this Site and place orders, you must:

• Be at least 18 years of age
• Be capable of entering into a legally binding contract under applicable law
• Provide accurate and complete information when creating an account or placing an order
• Be located in a jurisdiction where our products may be legally delivered

If you are placing an order on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms. If you do not have such authority, you must not accept these Terms or use the Site on behalf of such entity.

Your Account

When you create an account on our Site, you agree to:

• Provide accurate, current, and complete information at registration
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately at support@akaraonline.co.in of any unauthorised access to your account
• Not share your account credentials with any third party
• Not create more than one account per individual

We reserve the right to suspend or terminate accounts at our discretion if we suspect misuse, fraudulent activity, or a breach of these Terms. You may delete your account at any time via Account Settings or by contacting us.

Products & Pricing

Pricing

• All prices are listed in Indian Rupees (INR) and are GST-inclusive (18% GST applied as CGST 9% + SGST 9% for Maharashtra, or IGST 18% for other states)
• We reserve the right to change prices at any time without prior notice; however, the price displayed at the time of your order will be honoured
• Wholesale / bulk pricing (50+ units) is available on request and governed by a separate written quote

Product Descriptions

• All products are made-to-order using plant-based PLA on Bambu Lab 3D printers in our Thane, Maharashtra studio
• Product images are representative; actual appearance may vary slightly due to screen calibration and photographic conditions
• Dimensional tolerances of ±2–3mm are inherent to the 3D printing process and are not considered defects
• Custom colour orders are final — colour representation on screen may differ from the printed output
• All products are rated for indoor use only

Availability

All products are made-to-order and are therefore always "available" — subject to our current production capacity of 60–90 units per month. If an exceptional demand event prevents us from fulfilling your order within the stated lead time, we will notify you and offer a revised timeline or a full refund.

Section 06

Orders & Payment

Order Acceptance

Submitting an order does not constitute a contract until we confirm acceptance by email. We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

• Suspected fraudulent or abusive orders
• Incorrect pricing due to a technical error (we will notify you and offer a refund or the correct price)
• Unusually large orders that exceed current production capacity

Payment

• Full payment is required before production begins — we do not offer payment on delivery
• Accepted methods: UPI, Credit/Debit Cards, Net Banking (via Razorpay), and Bank Transfer (NEFT/IMPS)
• All transactions are processed over secure, encrypted connections
• We do not store your card details — payment processing is handled by Razorpay (PCI-DSS compliant)

GST Invoice

A GST-compliant tax invoice will be issued for every order and emailed to your registered email address. For B2B purchases requiring GSTIN on the invoice, please enter your GSTIN in your account profile before placing the order.

Section 07

Shipping & Delivery

Shipping terms are governed by our Shipping Policy, incorporated into these Terms by reference. Key points:

• Production lead time: 2–3 weeks (custom colours: 3–4 weeks)
• Standard delivery: 5–8 business days after dispatch
• Free standard shipping on orders above ₹2,500; ₹150 on orders below
• Express delivery available at ₹199 after production is complete
• We are not liable for delivery delays caused by courier partners, weather events, or force majeure situations outside our control

Title and risk of loss for Products passes to you upon confirmed delivery to the address you provided. We are not responsible for loss or damage after delivery is confirmed.

Section 08

Returns & Refunds

Returns and refunds are governed by our Refund Policy, incorporated into these Terms by reference. Key points:

• 7-day return window from delivery date (Consumer Protection Act, 2019)
• Eligible for return: damaged, defective, or wrong product delivered
• Custom colour orders are non-returnable (except for manufacturing defects)
• Refunds processed to original payment method within 5–14 business days depending on payment method
• 30-day manufacturing defect warranty from delivery date

Intellectual Property

All content on this Site — including but not limited to product designs, photographs, text, the ĀKĀRA wordmark, logo, brand name, and all 3D-printed design files — is the exclusive property of Precision Forge Labs and is protected by Indian copyright, trademark, and design law.

• You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission
• You may not use our brand name, logo, or product imagery in any commercial context without explicit written authorisation
• Personal, non-commercial use of product photographs (e.g., sharing on social media after purchase) is permitted, provided you credit @atelier.akara

Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved by the Company.

Section 10

Prohibited Use

You agree not to use this Site or our products for any of the following:

• Any unlawful purpose or in violation of applicable Indian law
• Transmitting spam, phishing attempts, or malicious code
• Attempting to access, scrape, or copy our pricing, product, or customer data by automated means
• Creating fake accounts, placing fraudulent orders, or submitting false information
• Reselling our products under a different brand without written authorisation
• Reverse-engineering, copying, or reproducing our product designs for commercial purposes
• Harassing or threatening our staff, customers, or suppliers

Violation of this section may result in immediate account termination, cancellation of pending orders, and legal action where appropriate.

Section 11

Limitation of Liability

To the maximum extent permitted by applicable Indian law, Precision Forge Labs shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages arising from your use of our products or Site
• Loss of revenue, data, profits, or business opportunities
• Damage to property caused by misuse of our products (using outdoors, submerging in water, load-bearing use)
• Errors or interruptions in Site availability
• Third-party actions, including but not limited to payment processors or courier partners

Our total liability to you in connection with any single transaction shall not exceed the amount paid by you for the product(s) in that transaction.

Section 12

Indemnification

You agree to indemnify, defend, and hold harmless Precision Forge Labs, its founders, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of our products or Site
• Your violation of any third party's rights, including intellectual property rights
• Any content you submit, post, or transmit through the Site

Section 13

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of our Site or products:

• Step 1 — Informal Resolution: Contact us at support@akaraonline.co.in. We will attempt to resolve disputes informally within 15 business days
• Step 2 — Jurisdiction: If informal resolution fails, any legal action shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India

For consumer disputes, you also have the right to approach the relevant Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.

Section 14

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send a notification email to all registered customers
• Provide a 14-day notice period before material changes take effect for existing customers

Your continued use of the Site after the effective date of any changes constitutes your acceptance of the updated Terms. If you disagree with the changes, you must stop using the Site and may request account deletion.
